TERMS AND CONDITIONS

“Garnier Pujor Show-stopper”

 

1. The “Garnier Pujor Show-stopper” (“Contest”), which is a on ground contest is conducted by Zee Entertainment Enterprises Limited (“ZEEL”) as a promotional activity for its channel “Zee Bangla” (“Channel”) and this Contest will be sponsored by “Loreal India Private Limited”(herein after referred as “Garnier” and/or “L’Oréal”), a company registered under the provisions of the Companies Act, 1956, having Corporate Identity Number U85190MH1991PTC060363 and having its registered office at A-Wing, Marathon Futurex, 8th, Floor,N.M Joshi Marg, Lower Parel-East, 400013, Mumbai Maharashtra, State Code : Maharashtra Country: India. Garnier and /or L’Oréal is the exclusive sponsorship partner of the contest and will be co-operating ZEEL to conduct the Contest.
    
2. The Contest shall  start from 12.00 IST on 15^th  September, 2022 and end at 11.59  IST on 4^th October, 2022  (“Contest Period”).
    
3. The Contest is open for interested Participant(s) who are residents of West Bengal as well as the resident outside of the State of West Bengal but within India.  
    
4. The details about Contest mechanism as follows but ZEEL at any time can alter/ change the Contest mechanism  at its sole discretion –   

• • ZEEL will create a microsite i.e. http://garnierpujorshowstopper.com/, wherein the interested Participants have to submit their Durga Pujo Selfie(s) and upload on the said microsite along with their details as desired by ZEEL in the said microsite (Herein after referred as “Entry”)
  • ZEEL and/or any agency on behalf of ZEEL shall setup small stalls at different conspicuous places including but not limited to the Metro Stations,  major shopping zones etc. within the city arear of Kolkata during the contest period stated hereinabove. There will be stalls/kiosk at such various places too including Maddox Square situated at 25, Palit Street, Kolkata-700019,_where  the interested Participants  may visit  such kiosks/stalls and share their “Durga Pujo Selfie(s)” with the authorized persons of ZEEL  along with their details. The authorized person(s) of ZEEL will help them to upload such Selfie(s) on the microsite along with their details (Entry).
  • Ground activities – Stalls will be installed by ZEEL and/or by any other Agency at different RWA(Resident Welfare Association) within the city area of Kolkata and Interested Participants have to visit such  stalls and  share their “Durga Pujo Selfie(s)” with the authorized persons of ZEEL  along with their details. The authorized person(s) of ZEEL will help them to upload such Selfie(s) on the microsite on behalf of the Participants along with their details. 

5. ZEEL may promote this Contest through the medium of the Channel, digital platform, ground activities, Social media, and any other manner as shall deem fit by ZEEL, at its sole discretion.
    
6. The Winner(s) of the contest will be selected by a panel of Jury (herein after referred as “Jury Panel”) who shall be engaged by ZEEL and/or  any agency/third party/entity as decided by ZEEL in its absolute discretion. The Jury Panel will evaluate the entries submitted by the participants showcased by the Participants.

The winners shall be determining in following manner;

There will be top 20(Twenty) participants, who will be selected by the said “Jury Panel" amongst the total entries submitted by the Participants through such microsite, such Jury Panel will scrutinize, and go through all the entries, images submitted by the interested Participants and shortlist final 20 (Twenty) Participants   at its sole discretion from the top entries received from the Microsite along with the ground activities. The final 20 (Twenty) Participants will be invited by ZEEL and/or the campaign back-end team to take part in the ‘Garnier Pujor Show-stopper 2022’, which will be held at Maddox Square, the venue of Zee Bangla Maha Pujo on Maha Nabami on 4^th October 2022. On the same day of grand finale, the selected participants will undergo a thorough grooming session under the supervision of a well-known lifestyle coach and groomer as decided by ZEEL. There will be multiple rounds for  various categories for both Men and Women and the Participants have to showcase thefir talent as desired by ZEEL. The “Jury Panel” will select 2 (Two) Participants as “Winners” (Herein after referred as “Winners”) and amongst the 2 (Two) Winners 1 (One) will be selected from male’s category and other 1(One) will be selected from female’s category.
 

7. It is made abundantly clear to the Participant(s) that the decisions of the Jury Panel and/or of ZEE BANGLA and/or ZEEL will be final and binding on all Participants.  No correspondence, clarification, explanation in this regard will be entertained by  ZEEL and /or “Channel” The Participants further agree, promise, assure and warrant that they shall not have any claims and/or raise any dispute regarding the Consent, decision of the Jury Panel and/or of  ZEEL and/or Channel or raise any claims or disputes against L’Oréal.
    
8. L’Oréal makes no representation or warranty with respect to decision of Jury Panel and/or of ZEEL and / or Channel in selection of the Winner(s) of the Contest. The decision and selection of Winner(s) is at the sole discretion of Jury Panel and/or of  ZEEL and / or Channel. L’Oréal will not be liable to pay any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising out of or in any way connected with decision of Jury Panel and/or of ZEEL and / or Channel in regard to the Contest.
    
9. The Participants acknowledge and accept that;

By participating into this contest, the Participants hereby agree and consent that all the personal details of the Participant(s) provided in the microsite will be used by L’Oréal at any point of time for promotional, publicity and marketing material, survey/sampling without any consent, reference, payment or other compensation to the Participant, subject to applicable privacy and data protection laws. 11. 1. 1. 2. After logging in to the microsite, the participant(s) shall be redirected to the dialogue box i.e. “I Agree” and by Clicking on such ‘I Agree’ box, Participants are agreeing to the Terms and Conditions of this contest and they are further agreeing to the processing of their data filled up in this form by L’Oréal in accordance with its Privacy Policy 
              

10. For sake of clarity, it is stated that all Entry(ies) should be considered after providing final Pan Card; Proof of identity cum permanent address proof – Aadhar card / Election card/permanent Driver’s License/Passport or any other document as ZEEL and/or Garnier and/ or L’Oréal  may deem fit; latest mobile bill of the Mobile Number from which the Winner has submitted his/her Entry and such other documents as may be required and informed by ZEEL and/or Garnier and/ or L’Oréal from time to time (“Documents”).
     
11. From amongst all the Participants, 2 (Two) Participants will be selected as Winners under this contest. Amongst the 2 (Two) Winners 1 (One) will be selected from male’s category and other 1(One) will be selected from female’s category. The Winners shall be entitled to receive Prize post adherence of verification process as mentioned in clause 10- 11 of the Terms and Condition. Each Winner  will receive INR 1,00,000/- (Indian Rupees One Lakh  Only)  along with Gift Hampers as decided by ZEEL at its sole discretion (herein after referred as “Prize”). A Participant can be declared as Winner only once during the Contest Period i.e. each Participant will be entitled to only one Prize. ZEEL shall pay the Prize money of 1 (one) lakh to each winners.
     
12. The participants/winners of the Contest hereby understand and accept that the prizes/gift hampers are given by Garnier and/ or L’Oréal, since Garnier and/ or L’Oréal has entered into an arrangement with ZEEL to enable Garnier and/ or L’Oréal to associate itself as the sponsor of the Contest and ZEEL is only delivering/handing over/presenting the gift hampers/prize/products of Garnier and/ or L’Oréal to the participants/winners on a “as is where is basis” and in the same condition as have been delivered to ZEEL by Garnier and/ or L’Oréal. The participants/winners of the Contest further understand and accept that the fitness, merchantability and quality of Garnier’s and/ or L’Oréal's  products/gift hampers/prizes rest solely with Garnier and/ or L’Oréal and ZEEL makes no claims/guarantees the quality, merchantability and fitness of such products/gift hampers/prizes. ZEEL further disclaims any liability and responsibility on such products/gift hampers/prizes and ZEEL will not be liable to pay any indirect, special, incidental, consequential, exemplary or punitive damages arising out of or in any way connected with Garnier and/ or L’Oréal goods and / or products. The participants/winners of the Contest are further advised to use such Garnier’s and/ or L’Oréal’s products/gift hampers/prizes at their sole risk and consequences and ZEEL bears no responsibility of side effects due to usage of such Garnier’s and/ or L’Oréal’s products/gift hampers/prizes by the participants/winners, who are advised to use the same at their own discretion. The participants/winners of the Contest assure and promise to make claims (if any) with regard to their usage of such Garnier’s and/ or L’Oréal’s products/gift hampers/prizes to directly to Garnier and/ or L’Oréal for any reason whatsoever, to the complete exclusion of ZEEL.”
     
13. For avoidance of doubt, it is clarified that apart from the Prize, Winner(s) shall not be entitled for any other gratification/ opportunity whether monetary or otherwise. Notwithstanding anything contained herein these Terms and Conditions, ZEEL shall have the sole discretion to choose and finalize the form and/or value of the Prize and the Participant/Winner shall have no claim in any manner whatsoever in this relation. The Participant understands and agrees that ZEEL shall have full discretion, without informing the Participant, to change the form of Prize and the Participant shall abide by the ZEEL’s decision to this effect.
     
14. The Winner(s) shall be eligible to avail the Prize only upon payment of tax, TDS and other charges (if applicable to be paid) as may be required to be paid upon the Prize ( as allocated by ZEEL)  incurred by the Winner within such time as communicated by  ZEEL. ZEEL and/or L’Oréal shall not be responsible if the Winners(s) fail to pay the tax, TDS and other charges (if applicable to be paid), within the timelines informed and it will be deemed that the Winner(s) has forfeited the offer and ZEEL reserves the right to select and declare another eligible Participant as a winner.
     
15. For avoidance of doubt, it is clarified that the ZEEL’s decision and prerogative in regard to the selection and declaration of the Winner(s) shall be final and binding. ZEEL at any time during or after the expiry of the Contest Period shall at it sole discretion increase or decrease the number of Winners to be selected by ZEEL for being entitled to receive Prize. For the sake of clarity, mere participating in the Contest and/or booking Stalls    does not entitle the Participant(s) to receive the Prize.
     
16. Each Winner shall receive a call from ZEEL or by any other agency on behalf of the ZEEL by directly calling on Mobile Number from which the Participant submitted its Entry (“Intimation Call”). ZEEL and/ or any other agency of behalf of ZEEL shall make only 3 (Three) attempt to contact the Winner(s) by calling on the Mobile Number of the Winner(s) registered with ZEEL. In case the Winner(s) fails to pick up the Intimation Call or if the Mobile Number shows busy network/ out of coverage network, the selection of that particular Winner shall be invalidated and ZEEL at its sole discretion may select another Winner from amongst the eligible Participant(s) who qualify as per the criteria stated above to receive Prize. ZEEL and/or L’Oréal shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which the Winner is un-reachable, due to which the ZEEL is unable to intimate the Winner.
     
17. The Intimation Call shall have instructions on the process required to be adhered by the Winner(s) which inter alia shall include the personal information (“PI”) of the Winner(s) such as name, contact number, email address, age, gender, name of parents, residential address etc. The Winner(s) shall be requested to furnish their latest photo with documents to ZEEL such as Pan Card; Proof of identity cum permanent address proof – Aadhar card / Election card/permanent Driver’s License/Passport or any other document as ZEEL may deem fit; latest mobile bill of the Mobile Number from which the Winner has submitted his/her Entry and such other documents as may be required and informed by ZEEL from time to time (“Documents”). All above mentioned Documents shall be self-attested and verified/attested by appropriate authorities and shall be submitted in such manner as specified by ZEEL. For sake of clarity, Participant will be considered as Winner only when she has been specifically declared as a Winner and not merely when she has been contacted by ZEEL for any purpose. The Winners agree to abide by all the rules, regulations and guidelines shared with them by ZEEL.
     
18. The Winner(s) shall furnish all requisite PI and Documents in a form and manner desired by ZEEL over Intimation Call. Post receiving the PI and Documents of the Winner(s), ZEEL shall verify the necessary PI and Documents at its end.    
     
19. Once the PI and/or the Documents have been verified by ZEEL, ZEEL and /or any other agency on behalf of ZEEL shall inform each Winner about the selection as one of the Winner and that she shall be entitled to the Prize as mentioned hereinabove. The Prizes may be modified/changed/revised at the sole discretion of ZEEL and Participant shall not have any claims or raise any concerns regarding the same.
     
20. The Prize given to the Winner by ZEEL is non-transferrable and non-exchangeable. The Winner agrees and undertakes that no cash equivalent or alternative gratification/ opportunity will be given to the Winner and the Winner cannot exchange the Prize/opportunity given for any kind of gift with value.  Further, the opportunity given to the Winner is personal in nature, hence the Winner cannot transfer the opportunity to any other person.  ZEEL makes no representation or warranty with respect to quality or functionality of the Prize and shall not be liable to the Winner in case of any product default or malfunctioning of the Prize.
     
21. The Participants/Winners agree, accept and acknowledge that they shall not at any time raise any objection regarding the stalls provided to them and other facilities provided to them. It is made abundantly clear that ZEEL’s decision will be final in case of the stalls provided to the Participants  and other facilities provided by ZEEL to the Winners.
     
22. The Winners/ Participants agree to abide by the Covid-19 guidelines implemented by the Central Government and State Government.  It is made abundantly clear to the Winners that if the Winner(s) / Participants(s)  get infected with Covid-19 post attending the Contest, ZEEL and/or L’Oréal shall not be responsible for the same and neither ZEEL and/or L’Oréal nor any of its affiliates or group companies shall be liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury or death, or loss of, or damage to property.
     
23. The Winners shall not in any circumstances make any claims against ZEEL entities arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly or any related activity, to the extent permitted under law. If the Winner is found to be ineligible, or if  she has not complied with any of the Terms and Conditions, the corresponding Entry will stand disqualified and such decision shall be final and binding.
     
24. The Participants and/or the Winners agree that the Participants and the Winners shall make himself/herself available from time to time and co-operate with ZEEL and participate in any activity and/or campaign relating to the Contest whatsoever without any money being payable to the Participants and/or Winners. The Participants and the Winners give their consent to ZEEL and/or any other agency / entity on behalf of ZEEL to make the footage of the participation in the Contest, .The Participants and the Winners in consideration of being afforded an opportunity to take part in the Contest, agree that the footage of any nature with regard to the Contest shall vest with ZEEL, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity and ZEEL may exploit the same in any manner and in any media whatsoever at any time throughout the world.
     
25. The Participants/ Winners hereby allow ZEEL and/or Garnier and/ or L’Oréal to use their face, name, signature, likeness, biographical data, caricature, autograph, initials, voice, photographs (selfie) to appear on including but not limited press conference(s), publicity events, integration, POP materials, hoarding, labeling, packaging merchandised or tie-in products/services, in connection with the promotion of the Contest and/or for any purpose in any and all media including, but not limited to, the press, internet, television (including cable) and satellite television throughout the Territory and in perpetuity.
     
26. For the sake of abundant clarity, it is made clear to the Participants/ Winners that they will be participating in the Contest at their own will and in case during the Contest  any unwanted/ unusual/ undesirable incident happens, ZEEL and/or L’Oréal shall not be responsible for the same and neither ZEEL and/or L’Oréal nor any of its affiliates or group companies shall be liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury or death, or loss of, or damage to property.
     
27. The Winners/ Participants  specifically warrant that they shall not indulge in any act(s), which are outside the parameters of any laws which may be in force in India, including but not limited to, the Indian Penal Code 1860 and the Narcotic Drugs and Psychotropic Substances Act, 1985. The Winners/ Participants  further agree and acknowledge that ZEEL has zero tolerance towards sexual harassment and shall promptly act upon any allegations of sexual harassment brought to ZEEL’s attention.
     
28. Family members and relatives of the employees of ZEEL and their group companies, affiliates, subsidiaries, holding companies are not eligible to participate in the Contest.
     
29. No dispute shall be entertained with regards to the selection criteria. Decisions of ZEEL shall be final and binding on the Participant(s).
     
30. Each Winner may have to sign any release form or other relevant document as required by ZEEL in order to receive Prize from ZEEL.
     
31. The Winner(s) hereby agrees to release and discharge ZEEL from Prize and Contest related obligation on ZEEL.   
     
32. All PI and Documents requested by and supplied to ZEEL by each Participant/Winner must be truthful, accurate and in no way misleading, failing which ZEEL reserves at its sole discretion the right to disqualify any Participant/Winner from availing the opportunity to participate in the Contest. 
     
33. Eligibility for participation in the Contest: Participation in this Contest is restricted to resident(s) of West Bengal and outside of West Bengal but within India only and who are above 18years of age as on the date of this Contest and (“Participant(s)”).
     
34. Grounds for disqualification to the Contest:

          2. Participant/ Winners failing to provide the required documents as stated above, within two (2) days of request by ZEEL. 
          3. Participant/ Winners found to be below 18 years of age as per the age proof submitted.
          4. Any of the documents/proofs not being properly attested, unclear, illegible and/or ZEEL has reasonable grounds to believe the same to be fraudulent.
          5. Entry submitted by proxy will not be accepted, even if the proxy is any of their family members.

35. Technology Limitations – ZEEL and/or L’Oréal, all participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries/ posts; (b) electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any disruptions, injuries, losses or damages caused by events beyond the control of ZEEL.
     
36. Each Participant to the Contest declares hereby that she is a real person in existence and not a computer programme.
     
37. ZEEL Garnier and/or L’Oréal does not and shall not subscribe for any claims / disputes / confirmation / responsibility in respect of the Contest including the Contest terms and conditions and any breach thereof.
     
38. ZEEL  nor any of its affiliates or group companies shall be liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury or death, or loss of, or damage to property, which is suffered or sustained in connection with the Contest or the Prize and further neither ZEEL nor any of its affiliates or group companies shall be responsible for any consumer grievances with respect the Contest or the Prize.
     
39. Each Participant expressly agrees that by his/her participation in the Contest, ZEEL and/ or its affiliates/ agents/ advisors or sub-contractors and/or Garnier and/ or L’Oréal and/ or its affiliates/ agents/ advisors or sub-contractors further can use the personal, sensitive collected information, in any media or future promotional, publicity and marketing material, survey/sampling without any consent, reference, payment or other compensation to the Participant, subject to applicable privacy and data protection laws. 
     
40. ZEEL and/or Garnier and/or L’Oréal shall have the right to share the Participant's personal information to any governmental or regulatory bodies if required by law, rule or statue and in response to a valid order of a court or authorized agency of the government or other legal process.
     
41. The Participants and the Winners will not make any defamatory/ derogatory statement against ZEEL/ Zee Bangla/ Garnier and/ or L’Oréal in any social media platform including but not limited to Facebook, Instagram or in any public forum at any point of time. If any such incident happens, ZEE shall have right to legal action against the Participants and the Winners.
     
42. The Participants and guardians of the Participants / Winners will be travelling to the venue(s) of audition and/or to the venue of the shooting of the Programme at their own cost, will, accord and risk.  ZEEL/ Zee Bangla and/or Garnier and/or L’Oréal shall not be responsible any manner for the same.
     
43. If the Grand Finale of Garnier Pujor Show-stopper 2022 continues till late night, the Participants/ the Winners shall stay at their own risk and arrangement.
     
44. Garnier and/or L’Oréal takes appropriate technical measures to protect the personal information provided by the Participant(s) against any kind of accidental and/or unlawful destruction or accidental loss, alteration, including but not limited to unauthorised disclosure or access and in case of any such event, ZEEL and/or Channel shall not be held liable for any reason whatsoever in relation to the data privacy of all the Participants ensured by Garnier’s and/or L’Oréal’s data privacy under this terms and conditions. 
     
45. Using of false names/ identities, illegal/false mobile numbers, fake email addresses and/or any other illegal means either online or in hard copies shall be considered as suppression of facts and if ZEEL has to suffer of any adverse consequence in this respect, the Participant/s shall be penalised for the same in a manner as ZEEL may deem fit.
     
46. Participants found indulging in any malpractices such as cheating, misrepresentation, providing false information shall be disqualified from the on-going Contest and strict legal action may be taken by ZEEL against such Participant(s).
     
47. ZEEL at its sole discretion reserves the right to modify the terms and conditions relating to the Contest from time to time and/or suspend, shorten, modify, extend or cancel the same without prior notice, without stating any reason and no claim in this regard shall be entertained. 48. All disputes arising out of or related to this Contest shall be subject to the exclusive jurisdiction of courts at Kolkata alone and subject to the laws of India only.
     
49. ZEEL at its own will and accord can cancel the entire Contest and ZEEL also reveres the right to reschedule the Contest at any point of time.
     
50. The Participants shall indemnify and hold ZEEL harmless, its group companies, affiliates and subsidiaries and their respective officers, directors and employees, against any loss that may occur to them due to non-adherence of these terms and conditions of the Contest.
     
51. Unless otherwise expressly stated, copyright, database right or similar rights in all material in relation to the Contest (including graphical images, text, video clips, demographics, sounds, demos, patches and other files) is owned, controlled or licensed by ZEEL or its affiliates and is protected or covered by copyright, trademark, intellectual property law and other proprietary rights. Unless with prior permission, no part of the Platform or the Contest may be reproduced or transmitted to or stored in any other website, nor any of its pages or part thereof be disseminated in any electronic or non-electronic form, nor included in any public or private electronic retrieval system or service.
     
52. The decision of ZEEL on all matters, queries or disputes, concerning the Contest including the selection and declaration of the Winners and the Contest terms and conditions shall be final and binding and no correspondence shall be entertained in this regard. 
     
53. By participating in the Contest, each Participant acknowledges and agrees to the terms and conditions contained herein and all related terms and conditions governing the Contest. The Participant agrees and acknowledges that she is aware that personal information collected by ZEEL and/or Garnier and/or L’Oréal will be used for purpose of the Contest and/or to reach out to Participant if the Participant is declared as a Winner and/or to inform Participant of any upcoming contest(s), campaign(s), survey(s), poll(s), etc., conducted on behalf of the Company. The Participant confirms that she is consenting for the Company to retain and use the Participants’ personal information for above purposes and if at any time the Participant does not want the Company to retain and/or use the Participants’ personal information, the Participant shall send a written communication to the Company at  chandan.paul1@zee.com to delete and destroy the personal information from date of such communication.
     
54. The duration and other rules/regulations of the Contest shall be at the discretion of ZEEL only.
